Agreement Between User and Patrick Markert Hypnotherapy

Welcome to www.patrickmarkert.com (the “Site”). The Site is owned and operated by Patrick Markert Hypnotherapy (“Patrick Markert Hypnotherapy,” “we,” “us,” or “our”).

These Terms of Use (“Terms”) govern your access to and use of the Site, including its content, appointment-booking features, contact forms, digital materials, and links to services provided by third parties. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The Site provides information about hypnotherapy and related services offered by Patrick Markert, a Certified Hypnotherapist. It may also allow users to request or book appointments, make payments, access remote sessions, contact Patrick Markert Hypnotherapy, and purchase or receive digital recordings or other materials.

Professional Disclosure and Nature of Services

Patrick Markert is a Certified Hypnotherapist and does not provide medical, psychological, psychiatric, or licensed mental health services.

Hypnotherapy is intended to support personal growth, relaxation, stress reduction, behavioral change, emotional insight, self-awareness, and overall well-being. It is not a substitute for medical care, psychotherapy, psychological counseling, psychiatric treatment, diagnosis, or crisis intervention.

Information provided on the Site is for general informational and educational purposes only. Nothing on the Site creates a physician-patient, psychotherapist-client, or other licensed healthcare relationship.

If you are experiencing a medical or mental health emergency, believe you may harm yourself or another person, or otherwise require immediate assistance, call 911 or contact an appropriate emergency or crisis service. The Site and its contact forms are not monitored as emergency resources.

No Guarantee of Results

Hypnotherapy is a collaborative and individualized process. Experiences and outcomes vary, and no particular result is promised or guaranteed. Testimonials, descriptions of services, and examples of possible benefits represent individual experiences or general information and should not be interpreted as guarantees of what any particular person will experience.

Informed Consent and Service-Specific Terms

Booking or participating in hypnotherapy services may require you, or a parent or legal guardian when applicable, to complete and accept a separate Client Intake and Hypnotherapy Informed Consent form. Any policies or terms presented during booking, payment, intake, or informed consent apply in addition to these Terms.

If a service-specific agreement conflicts with these Terms regarding your participation in that service, the service-specific agreement will control to the extent of that conflict.

Eligibility and Services for Minors

You must be at least 18 years old to book services for yourself.

Hypnotherapy services may be provided to a person under 18 only with the authorization and informed consent of a parent or legal guardian and at the discretion of Patrick Markert Hypnotherapy. A parent or legal guardian who books or authorizes services for a minor represents that they have the legal authority to provide that consent and agrees to comply with all applicable service policies.

The Site is not directed to children for independent use. Minors should use the Site only with the involvement and permission of a parent or legal guardian.

Payment, Cancellation, and Appointment Policies

Appointments must be scheduled at least 72 hours in advance.

Payment is due at the time of booking, is required to reserve an appointment, and is nonrefundable.

Appointments may be rescheduled with at least 48 hours’ notice. Appointments canceled or rescheduled with less than 48 hours’ notice, and missed appointments, will result in forfeiture of the payment.

Sessions that begin late because of client delay will still conclude at the scheduled ending time.

After booking, clients must complete and electronically sign the applicable Client Intake and Hypnotherapy Informed Consent form within 24 hours. This information is needed to prepare an approach tailored to the client’s goals and needs. A hypnotherapy session cannot proceed unless the completed form and electronic signature have been received.

Additional appointment details or policies displayed during booking form part of your agreement with Patrick Markert Hypnotherapy. If Patrick Markert Hypnotherapy must cancel or reschedule an appointment, we will communicate with you regarding available options.

Remote Sessions

Remote sessions may be conducted through Zoom or another third-party platform. You are responsible for having a suitable device, a reliable internet connection, and a safe, quiet, and reasonably private location.

You may not participate in a Discovery Call or hypnotherapy session while driving. During hypnosis, you must not drive, operate machinery, or engage in any activity that requires your full attention. You may not participate in a hypnotherapy session while under the influence of alcohol or recreational drugs.

Although reasonable efforts are made to support privacy, no internet-based communication or videoconferencing platform can be guaranteed to be completely secure or uninterrupted.

Session Recordings and Digital Materials

Hypnotherapy sessions are recorded only with the client’s permission. Any session recording provided to a client is for that client’s personal, private use and may not be published, posted online, distributed, sold, altered for redistribution, or used for commercial purposes without prior written permission from Patrick Markert Hypnotherapy.

Unless different written license terms are provided at the time of purchase or delivery, prerecorded hypnotherapy audio, personalized recordings, scripts, written exercises, and other downloadable or digital materials are licensed to the recipient for personal, noncommercial use only. Purchasing or receiving a recording or other material does not transfer ownership of the underlying content or intellectual-property rights.

Hypnotherapy recordings must not be used while driving, operating machinery, or participating in any activity that requires alertness. You are responsible for deciding whether the setting and timing are appropriate for listening.

Privacy

Your use of the Site is also subject to the Patrick Markert Hypnotherapy Privacy Policy, which describes how information may be collected, used, and shared. Please review that policy before submitting personal information through the Site.

Information voluntarily submitted through general website forms or email should not be considered suitable for urgent, emergency, or highly sensitive communications. Information provided through intake, consent, scheduling, or payment systems may also be handled by the third-party providers that operate those systems, subject to their own privacy and security practices.

Electronic Communications

By contacting Patrick Markert Hypnotherapy, booking a service, or otherwise providing your email address, you consent to receive electronic communications related to your inquiry, appointment, purchase, forms, or services. You agree that electronic notices and communications satisfy any requirement that such communications be provided in writing, to the extent permitted by law.

Marketing emails, if offered, will include a method for unsubscribing. Transactional or service-related communications may still be sent when necessary to administer an appointment, purchase, or ongoing client relationship.

Third-Party Websites and Services

The Site may contain links to or integrations with third-party websites and services, including Zoom, Stripe, Squarespace Scheduling, Jotform, Facebook, Instagram, and other service providers. These third parties are independently operated and may have their own terms, privacy policies, security practices, and accessibility standards.

Patrick Markert Hypnotherapy does not control and is not responsible for the content, availability, policies, security, or practices of third-party websites or services. A link does not necessarily constitute an endorsement. Your use of a third-party service is governed by your agreement with that third party.

Information necessary to complete a booking, payment, remote session, form submission, or other requested function may be processed by the applicable third-party provider.

Unless otherwise indicated, the Site and its original content—including text, service descriptions, articles, scripts, audio, recordings, graphics, logos, images, and the arrangement of that content—are owned by or licensed to Patrick Markert Hypnotherapy and are protected by applicable copyright, trademark, and other intellectual-property laws.

  • To attempt to gain unauthorized access to the Site, its systems, or information belonging to another person;

  • To introduce malware, malicious code, or disruptive technology;

  • To scrape, harvest, copy, or systematically collect Site content or user information without permission; or

  • To misrepresent your identity, authority, or relationship with another person.

Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. Patrick Markert Hypnotherapy does not warrant that the Site will always be available, secure, uninterrupted, or free from errors, or that all information will be complete, current, or suitable for every purpose.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by law, Patrick Markert Hypnotherapy will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the Site; your reliance on general Site content; the conduct or availability of a third-party website or service; or unauthorized access to or alteration of information transmitted through the Site.

These limitations do not apply to liability that cannot lawfully be limited or excluded, including liability arising from gross negligence, willful misconduct, or unlawful conduct.

The separate informed-consent agreement applicable to hypnotherapy services may contain additional acknowledgments and limitations concerning voluntary participation in those services.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Patrick Markert Hypnotherapy from claims, losses, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Site, your violation of these Terms, or your infringement of another person’s rights.

The Site is controlled and operated from Oregon, United States. If you access the Site from another state or country, you are responsible for determining and complying with any laws that apply to your use of the Site or participation in services from your location. Availability of the Site does not mean that all services are appropriate or legally available in every jurisdiction.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute relating to the Site or these Terms that is not otherwise governed by a separate written agreement will be brought in a court of competent jurisdiction in Oregon, except where applicable law requires otherwise.

Termination or Restriction of Access

Patrick Markert Hypnotherapy may restrict or terminate access to the Site or any portion of it when reasonably necessary to protect the Site, its users, its content, or its operations; to address a violation of these Terms; or to comply with law.

Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or modified to the minimum extent necessary, and the remaining provisions will remain in effect.

These Terms, together with the Privacy Policy and any applicable booking, informed-consent, purchase, or service-specific terms, constitute the agreement governing your use of the Site. They do not replace any separate written agreement governing particular services.
